In connection with the use of its applications, Fidwork processes your Personal Data, which is defined as any data enabling you to be identified directly or indirectly. We process the following Personal Data:

  • Your identity (surname, first name).
  • Your contact details (e-mail address, telephone number).

On this website, the demo request form collects your profile (contractor or plant operator), your name, your company, your business e-mail and, if you wish, your phone number. This information is used solely to get back to you about your request. It is neither sold nor transferred to third parties. It reaches us by e-mail through Mailjet, our e-mail delivery provider.

3. Why do we process your personal data?

Certain services that you use require the collection and retention of a number of automatically recognised items: the date and time, the IP address, the phone model, the geolocation and the operating system used (if the browser or application communicates this information), the object requested and the execution status of the request.

We also retain the personal data you voluntarily provide to us when using our contact form. This form includes mandatory data to enable us to respond to your contact request (identity, e-mail, company…).

Fidwork uses and retains users' personal data in order to be able to respond to requests as well as possible and to produce statistics that make the use of the Fidwork platform more efficient.

The processing of your personal data is justified by different grounds (legal basis) depending on the use we make of it:

  • The processing of your personal data is necessary for pre-contractual measures or for the performance of the contract you may enter into with Fidwork in order to benefit from the services of the Fidwork platform.
  • You have consented to the processing of your personal data for the purposes stated when your consent was obtained, which are detailed in this section. You may withdraw this consent at any time.
  • The processing serves the legitimate interest of Fidwork.

4. Retention period for your personal data

Your personal data is retained:

  • For a period of 3 years from your last activity with Fidwork, as regards commercial data.
  • For a period of 3 years from the end of the contract (from your last exchange with Fidwork), as regards the data we use for client relationship management purposes.
  • For a period of 36 months from collection, as regards consumption data in detailed form, then in aggregated form for the remainder of the contract term.

5. Recipients of your personal data

Your personal data may also be transmitted to third parties:

  • To our provider of an e-mail sending solution, in the form of notifications, alerts or newsletters: Mailjet.
  • To our regulatory authorities, to authorities responsible for law enforcement or fraud prevention, as well as to our advisers (including lawyers or statutory auditors), to the courts and to any other authorised body, for the purpose of investigating any actual or suspected criminal activity or other regulatory or legal matters, etc.
  • If we are under an obligation to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other contracts, or to protect the rights, property or safety of Fidwork, our clients or other persons.
  • To our legal and other advisers in the context of legal proceedings in order to assert or enforce our rights under any contract.

In any event, your Personal Data is not transferred outside the European Union.

As part of the management of e-mail communications (sign-ups, notifications, newsletters, etc.), our platform uses the Mailjet service, an e-mail sending solution offered by the company Mailjet SAS, whose registered office is located in France. Mailjet acts as a processor within the meaning of the GDPR, which means that it processes the personal data we transmit to it solely on our instructions, for the purpose of ensuring the deliverability of our e-mails. The data concerned may mainly include your e-mail address, your name and information relating to your interactions with our messages (opens, clicks). Mailjet complies with the requirements of the GDPR. You can consult its privacy policy.

6. Exercising your rights

Before processing your personal data, and at the latest at the time your personal data is collected, we will inform you of the purpose of the processing of your personal data, the recipients of that data, the retention period applied to your personal data and your rights in this context. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with the loi Informatique et Libertés of 6 January 1978, as amended, you have the right of access, the right to rectification, the right to restriction of processing and, where applicable, the right to erasure of your Personal Data. You also have the right to data portability. You may also have the right, on legitimate grounds, to object to the processing of Personal Data concerning you.

  • Right of access. You have the right to request confirmation of the processing of your personal data, access to that personal data (by being provided with a copy) and other information about how we process your personal data.
  • Right to rectification. You have the right to ask us to rectify your Personal Data if it is inaccurate or incomplete.
  • Right to restriction of processing. You have the right to request the restriction of the processing of your personal data, provided that the data we hold about you is incorrect, that you consider the processing applied to your data to be unlawful, that we no longer need your personal data for the purposes referred to above but it is still required for the establishment, exercise or defence of your legal claims, or that you wish to verify the legitimate grounds we rely on to justify one of our processing operations.
  • Right to data portability. You have the right to obtain from us the personal data we have collected about you (in a structured, commonly used and machine-readable format) in order to reuse it for your own purposes in other services. This allows you to easily transfer personal data to another data controller or to ask us to do so for you.
  • Right to object. You have the right to object to the processing of your Personal Data based on our legitimate business interests, unless we are able to demonstrate that, on balance, our legitimate interests override your rights or if we need to continue processing your personal data for the establishment, exercise or defence of legal claims. However, you also have the right to object to the processing of your personal data for direct marketing purposes without having to give reasons for this request.
  • Withdrawal of consent. You have the right to withdraw your consent to the processing of your personal data at any time.

You may exercise these rights, upon presentation of a copy of your identity document, by simple written request sent by e-mail to dpo@fidwork.fr or by post to Fidwork SAS, 100 impasse des Houillères, ZA Le Pontet, CS 50014, 13590 Meyreuil, France.

You also have the option of completing this form. Please note that, in this case, the data is stored on a server owned by the company Microsoft.

We will respond to any request received from you within one month of the date of the request. If your request is not sufficiently precise or does not contain all the information needed to respond to it, Fidwork may ask you to provide additional information.

You also have the right to lodge a complaint with the national data protection authority. In France, this authority is the Commission Nationale de l'Informatique et des Libertés (CNIL).

Operations involving a third-party recipient are governed by a contract in order to ensure the protection of personal data and respect for Users' rights.
